These Terms of Service (“Terms”) govern your use of TrailGrid’s website building and hosting services. By using our services, you agree to these Terms.

Service Description

TrailGrid provides website design, hosting, and optimization services for local service businesses. Our services include:

• Custom website design tailored to your business
• Website hosting on our infrastructure
• Search engine optimization (SEO) and AI search optimization
• Performance optimization (Lighthouse scoring)
• Lead capture and forwarding
• A customer portal for managing your website content

Pricing and Payment

• Setup fee: $100 one-time payment, due at onboarding
• Monthly subscription: $49 per month, billed monthly via Stripe

All payments are processed through Stripe. Prices may change with 30 days written notice to active customers. Price changes do not apply retroactively to current billing periods.

Subscription Terms

Your subscription is month-to-month with no long-term commitment. Your subscription automatically renews each month unless cancelled. You can cancel at any time through the Billing section of your customer portal or by emailing [email protected].

Cancellation

When you cancel your subscription:

• Your website remains live through the end of your current billing period
• Your website goes offline within 7 days after your billing period ends
• You have 30 days after cancellation to request an export of your content and photos
• After 30 days, your data is permanently deleted

Intellectual Property

Your Content

You retain ownership of all content you provide or upload, including business photos, logos, text, and descriptions. You grant TrailGrid a license to display this content on your website and in our systems for the purpose of providing the service.

Our Technology

TrailGrid retains ownership of all website templates, code, design systems, and technology used to build and host your website. This license to use our technology is limited to the duration of your active subscription.

Customer Responsibilities

You agree to:

• Provide accurate business information
• Only upload content you have the right to use
• Not use your website for illegal, deceptive, or harmful purposes
• Keep your account credentials secure
• Respond to communications about your account in a timely manner

Acceptable Use

Your TrailGrid website may not be used to promote illegal activities, distribute malware, infringe on intellectual property rights, engage in fraud or deception, or host content that violates applicable law. We reserve the right to suspend or terminate accounts that violate this policy.

Service Availability

We strive for high uptime but do not guarantee uninterrupted service. We are not liable for temporary outages caused by maintenance, infrastructure providers, or events beyond our reasonable control.

Limitation of Liability

To the maximum extent permitted by law, TrailGrid’s total liability for any claims arising from or related to these Terms or our services is limited to the total amount you paid us in the three months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

Disclaimer of Warranties

Our services are provided “as is” without warranties of any kind. While we optimize your website for search performance and AI discovery, we do not guarantee specific search rankings, traffic volumes, lead counts, or revenue outcomes.

Dispute Resolution

Any disputes arising from these Terms will be resolved through good-faith negotiation. If we cannot resolve a dispute informally, it will be settled through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the state of Colorado.

Changes to These Terms

We may update these Terms from time to time. We will notify active customers of material changes via email at least 30 days before they take effect. Continued use of our services after changes take effect constitutes acceptance of the updated Terms.
